Destruction of Records Notice

NOTICE OF DESTRUCTION OF SPECIAL EDUCATION RECORDS

2025-26 SCHOOL YEAR

Newport School District (NSD) maintains Special Education records related to the identification, evaluation, educational placement, and/or the provision of Special Education in the district. Under state and federal laws, these records must be retained for a period of six years after Special Education services have ended for the student. Special Education services end when the student is no longer eligible for services, graduates, completes his or her educational program at age 22, or moves from the district.

THIS IS NOTICE of NSD’s intent to destroy the Special Education records of students who are no longer receiving Special Education services as of the end of the 2025-2026 school year.  These records will be destroyed in the fall of 2032, in accordance with state law.

After six years, the records are no longer useful to the district, but may be useful to the former student or parent/guardian, in applying for Social Security benefits, rehabilitation services, college entrance, etc.  The adult student, or *parent who has retained parental rights, may request the records in writing or in person at the following address:

*According to federal law, parents and guardians lose their right to review or obtain these records when their child (the student) reaches 18 years of age or parent(s) have retained parental rights, provided that the child has been determined to be legally incompetent or legally incapacitated.


YEARS PRIOR TO 2018

Newport School District will begin the destruction of special education records of all students who have moved, graduated or exited from any special education program prior to the 2018 school year.

Special Education records are retained by the district for 6 years beyond exit or graduation from services.. Destruction of these records is the best protection against improper or unauthorized disclosure. Students may request a copy of their records by contacting Keri Leslie at (509) 447-3167 x4507 or emailing lesliekeri@newportgriz.com by October 31, 2025. Individuals 18 years of age or older, unless adjudicated, must request their own records. Identification is required.

Destruction of these records will begin November 1, 2025.
